The point of the license is not to stop people from stealing your stuff. The purpose of the license is to let people who follow copyright rules use your stuff without going through the lengthy and messy process of contacting you and obtaining permission.

I don't know if this is legally clear. People take pictures of other people's copyrighted things and those pictures are owned by the picture taker. It could be argued, even, that Nintendo has given up their right to those images by letting you take them.
Large companies like IGN have created snapshot sharing websites, and I haven't heard anything about Nintendo suing them for facilitating copyright infringement.
I have personally emailed Nintendo's legal staff on this issue and they have yet to get back to me for over 1 month.
